RECOMMENDATION(S):

APPROVE and AUTHORIZE the Public Works Director, or designee, to execute the Right of Way Contract to convey approximately 5,947 square feet of property (“Highway Property”) to Pacific Gas and Electric Company (PG&E) in exchange for PG&E’s conveyance of approximately 3,440 square feet of PG&E owned property (“PG&E Property”) to the County in connection to the SR4 (E) Widening – Somersville Rd to Route 160 project, pursuant to Streets and Highways Code section 960, as recommended by the Public Works Director. Antioch area.  
  

AUTHORIZE the Chair, Board of Supervisors, to execute a Quitclaim Deed to PG&E on behalf of the County and;  





RECOMMENDATION(S): (CONT'D)
  
ACCEPT a Quitclaim Deed from PG&E conveying the PG&E Property to the County and;  
  
DETERMINE that the Highway Property was acquired by the County for highway purposes but is no longer needed for those purposes. (Project No. 4660-6X4168, [SCH# 2004092135]) and;  
  
DIRECT the Real Estate Division of the Public Works Department to cause said Quitclaim Deed from PG&E to be recorded at the County Clerk-Recorder’s Office and cause said Quitclaim Deed from the County to be delivered to PG&E for acceptance and recording.

FISCAL IMPACT:

100% Contra Costa Transportation Authority Funds.

BACKGROUND:

In 2010, the County acquired right of way along Sunset Drive in Antioch for highway purposes. The property was acquired entirely with Contra Costa Transportation Authority ("CCTA") funds. The County was responsible for acquiring right of way for the project on CCTA’s behalf.  
  
The improvements along Sunset Drive are completed and an excess portion of land is no longer required for the project or for other highway purposes. CCTA has requested that the County convey the excess property to PG&E. PG&E is willing to accept the property in exchange for property required for the project.   
  
The County and PG&E will exchange property rights in their as-is condition. Each party will release the other party from all claims related to the condition of the property before conveyed.

CONSEQUENCE OF NEGATIVE ACTION:

The County would continue to own and be liable for the maintenance of the property that is no longer required for highway purposes.
