RECOMMENDATION(S):

1. ACKNOWLEDGE that the Member 3 seat of the Retirement Board was vacated on April 24, 2021 upon the retirement of incumbent Todd Smithey from the Central Contra Costa Sanitary District.

2. ADOPT Resolution No. 2021/154 calling and noticing election of Retirement Board Member Number 3 (general), as recommended by the Contra Costa County Employees’ Retirement Association Board.

FISCAL IMPACT:

None.

BACKGROUND:

The Member No. 3 (General Member) seat of the Contra Costa County Employees’ Retirement Association Board was vacated on April 24, 2021 upon the retirement of incumbent Todd Smithey from the Central Contra Costa Sanitary District. The general members of the Association may elect the No. 3 member, as provided in the attached Resolution. The election would be to fill the seat for the remainder of the current three-year term, which will expire on June 30, 2023.

Until a successor to Mr. Smithey qualifies, Government Code section 31520.1 provides, in part, that the alternate seventh member shall fill a vacancy in the Member 3 seat. The alternate seventh member seat is held by Reggie Powell.

Nominations for the Member No. 3 seat shall be on forms provided by the County Clerk starting on Monday, May 17, 2021 and filed in that office not later than 5 p.m. on Friday, June 11, 2021. Election Day is fixed as Tuesday, September 7, 2021. Any Ballot reaching the County Clerk’s Office after 5 p.m. on Tuesday, September 7, 2021 shall be voided and not counted.

CONSEQUENCE OF NEGATIVE ACTION:

Inaction would delay in election of the 3rd member of the Contra Costa County Employees’ Retirement Association Board.
