RECOMMENDATION(S):

APPROVE and AUTHORIZE the County Counsel, or her designee, to execute, on behalf of Contra Costa County, a contract amendment for specialized professional services with Ellis Buehler Makus, LLP.

FISCAL IMPACT:

Services will be billed at hourly rates not to exceed $320.00 per hour and will be charged to the County Departments which utilize the services. The total contract amount will be increased from $100,000 to $200,000.

BACKGROUND:

County departments require on-going legal assistance conducting workplace investigations, preparing for anticipated litigation, and providing legal advice. The law firm of Ellis Buehler Makus, LLP has specialized expertise in the area of employment law and litigation. The County entered into a contract with Ellis Buehler Makus, LLP on October 1, 2018 for legal assistance to the County in its workplace investigations. The total contract amount has been reached. It is requested that the contract be amended to provide a new total contract amount of $200,000.

CONSEQUENCE OF NEGATIVE ACTION:

The County will be unable to obtain the firm's services.
