RECOMMENDATION(S):

APPROVE and AUTHORIZE the County Administrator, or designee, to execute an agreement with the State of California Department of State Hospitals to pay the County an amount not to exceed $3,114,100 to administer a pre-trial felony mental health jail diversion program for individuals charged with felony offenses in Contra Costa County for the period of May 1, 2020 through April 30, 2023.

FISCAL IMPACT:

The total cost of the program is approximately $4,137,000 over 3 years. The County will receive $3,114,100 from California Department of State Hospitals. The remaining 3-year cost of $1,023,000 will be funded by the County from AB 109 reserves . The estimated total annual cost for the program is $1.34 million for FY 20/21, $1.38 million for FY 21/22, and $1.42 million for FY 22/23. Upon contract execution, the County will receive $788,525 in one-time program implementation funds. The remaining balance of funds will be remitted to the County based on the successful admission of unduplicated Felony Mental Health Diversion Clients.







BACKGROUND:

Assembly Bill No. 1810 (2018) authorized the State of California Department of State Hospitals (DSH) to contract with the County to help fund the development and/or expansion of pretrial diversion for individuals with serious mental disorders who may otherwise be found incompetent to stand trial and committed to DSH for restoration of competency. The bill would require participants in the pretrial diversion program to meet specified criteria, including, among others, that they suffer from certain mental disorders and have felony charges, and that there is a significant relationship between the serious mental disorders and the charged offense.   
  
Under this agreement, the County will administer a pre-trial jail felony mental health diversion program for individuals charged with felony offenses in Contra Costa County. Program participants will be individuals with serious mental disorders who have committed certain felony crimes and found by the Superior Court to qualify for diversion services pursuant to Penal Code § 1001.36. In addition to establishing the appropriate processes within the County's justice system, additional staffing will be provided in Health Services, Public Defender's Office, and the District Attorney's Office to properly administer the program. The agreement will provide the County the resources needed to provide clinically appropriate and evidence-based mental health treatment and wraparound services across a continuum of care to meet the individual needs of the participating clients. The program will include adding forensic elements, such as Cognitive Behavioral Social Skills Training (CBSST) and the “Criminal Thinking” curriculum for group therapy, to the three regional Assertive Community Treatment (ACT) programs. The program also provides for the enhancement of the County’s regional ACT programs with master-lease housing.

CONSEQUENCE OF NEGATIVE ACTION:

The County will not have access to the resources necessary to expand the County's felony mental health diversion program.
