RECOMMENDATION(S):

ADOPT Position Adjustment Resolution No. 25602 authorizing the addition of positions (as specified in the attached) in the District Attorney's Office, the Health Services Department and the Public Defender's Office for the provision of a felony mental health diversion program.

FISCAL IMPACT:

$1,059,000 annually; $243,000 in the District Attorney's Office, $448,000 in the Health Services Department, and $368,000 in the Public Defender's Office. 34% AB 109, 66% State. Of the total amount, $198,000 is attributable to employer pension costs.








BACKGROUND:

Assembly Bill No. 1810 (2018) authorized the State Department of State Hospitals (DSH) to contract with the County to help fund the development and/or expansion of pretrial diversion for individuals with serious mental disorders who may otherwise be found incompetent to stand trial and committed to DSH for restoration of competency. The bill would require participants in the pretrial diversion program to meet specified criteria, including, among others, that they suffer from certain mental disorders and have felony charges, and that there is a significant relationship between the serious mental disorders and the charged offense.  
  
This action creates 7.0 FTE new positions; 1.0 FTE in the District Attorney's Office, 4.0 FTE in the Health Services Department, and 2.0 FTE in the Public Defenders Office to provide the necessary staff to expand the County's mental health diversion services through the agreement with DSH. The positions are identified in P300 No. 25602 attached to this board order.  
  

CONSEQUENCE OF NEGATIVE ACTION:

The positions outlined in the position adjustment resolution will not be authorized by the Board and the County will not be able to expand the County's felony mental health diversion program.
