RECOMMENDATION(S):

1. ADOPT Resolution No. 2019/191, ordering a special tax measure for police protection services in County Service Area P-2, Zone A, to be withdrawn from the August 27, 2019, ballot and cancelling the election.  
  

2. INTRODUCE Ordinance No. 2019-19, which repeals Ordinance No. 2019-13, WAIVE reading, and FIX June 11, 2019, for adoption.  








FISCAL IMPACT:

If approved, the proposed actions would eliminate both the cost of the election and any potential revenue increases. The approximate $10,000 cost of the election would have been paid from ad valorem property tax revenues previously allocated to Zone A. If approved by the voters, the parcel tax was expected to generate approximately $381,000 annually in additional revenue to support extended police protection services in the defined area.   
  

BACKGROUND:

On May 21, 2019, the Board of Supervisors adopted Ordinance No. 2019-13. Under the ordinance, beginning in fiscal year 2020-2021, special taxes levied in the Zone for police protection would be increased to $380 per parcel for residential properties (single, small multiple and large multiple), $3,040 per parcel for commercial/industrial/institutional properties and $13,300 per parcel for commercial/theater parcels. The ordinance also would tax parcels owned by the Blackhawk Country Club, which are currently exempt from the Zone A police protection special tax. Also on May 21, 2019, the Board adopted Resolution No. 2019/147, which directed Ordinance No. 2019-13 to be presented to the CSA P-2 Zone A voters in a mail ballot election on August 27, 2019.   
  
Elections Code section 9605 authorizes the Board of Supervisors to adopt a resolution withdrawing a measure from the ballot if the resolution is adopted and filed with the Elections Office no less than 83 days before the election. Resolution No. 2019/191 orders Ordinance No. 2019-13 to be withdrawn from the August 27, 2019, ballot and cancels the election on the special tax measure in CSA P-2A. Ordinance No. 2019-19 repeals Ordinance No. 2019-13. If the Board approves the introduction of Ordinance No. 2019-19, the ordinance will be placed on the June 11, 2019, consent calendar for adoption. Resolution No. 2019/191 takes effect immediately upon adoption by the Board.   

CONSEQUENCE OF NEGATIVE ACTION:

If the Board does not take the recommended actions, the proposed tax measure would be submitted to CSA P-2 Zone A voters for consideration on August 27, 2019.
