RECOMMENDATION(S):

ADOPT Resolution No. 2019/166 accepting completion of improvements for Drainage Improvement Agreement and release of cash deposit for faithful performance for drainage acceptance DG04-00051 (cross-reference subdivision SD80-06013) for a project developed by SDC Delta Coves, LLC, a Delaware Limited Liability Company, as recommended by the Public Works Director, Bethel Island area. (District III)

FISCAL IMPACT:

100% Developer Fees.

BACKGROUND:

The developer has completed the improvements per the Drainage Improvement Agreement, and in accordance with the Title 9 of the County Ordinance Code.

CONSEQUENCE OF NEGATIVE ACTION:

The developer will not receive a refund of the cash deposit, the Drainage Improvement Agreement and surety bond will not be exonerated, and the billing account will not be liquidated and closed.
