RECOMMENDATION(S):

ADOPT Resolution No. 2019/163 approving the third extension of the Drainage Improvement Agreement for drainage acceptance DA11-00068 (cross-reference SD04-08856), for a project being developed by Shapell Homes, a Division of Shapell Industries, Inc., a Delaware Corporation, as recommended by the Public Works Director, San Ramon, (Dougherty Valley) area. (District II)  

FISCAL IMPACT:

No fiscal impact.

BACKGROUND:

The terminal date of the Drainage Improvement Agreement needs to be extended. The developer has completed the required improvements and has requested more time for the warranty period. (Approximately 100% of the work has been completed to date.) By granting an extension, the County will give the developer the ability to keep the bond current.  



CONSEQUENCE OF NEGATIVE ACTION:

The terminal date of the Drainage Improvement Agreement will not be extended and the developer will be in default of the agreement, requiring the County to take legal action against the developer and surety to get the improvements installed.
