RECOMMENDATION(S):

  1. CONSIDER waiving the 180-day sit-out period for Brian Douglas Hast, Deputy District Attorney, and Julie Ann Hast, Deputy District Attorney, in the District Attorney's Office;

  2. FIND that the appointment of Brian Douglas Hast and Julie Ann Hast are necessary to fill critically needed positions; and

  3. APPROVE and AUTHORIZE the hiring of County retirees Brian Douglas Hast and Julie Ann Hast as temporary County employees effective May 13, 2019 and serving through June 30, 2020.



FISCAL IMPACT:

Each temporary employee will be limited to 960 hours per fiscal year. The total estimated cost for both temporary employees is $200,000. Sufficient funds will be appropriated and available in the District Attorney's budget through vacancy savings.

BACKGROUND:

Brian Douglas Hast and Julie Ann Hast retired from County service on March 30, 2019 as Deputy District Attorneys (Advanced). With a combined 70 years of experience in the Contra Costa District Attorney's Office, they are qualified and will be assigned as needed to fulfill the operations of the District Attorney's Office. Their experience includes Homicide, Sexual Assault, Juvenile, Felony Preliminary Hearings, Felony Trial Team, Special Operations, Fraud, Felony Filing, and Expediting.   
  
There are currently 11 vacant attorney positions inclusive of one (1) Chief Assistant District Attorney and three (3) Senior Deputy District Attorney positions. The immediate appointments of Brian Douglas Hast and Julie Ann Hast are necessary to fill critically needed positions in the District Attorney's Office.

CONSEQUENCE OF NEGATIVE ACTION:

With over 10% of the attorney positions vacant in the District Attorney’s Office, the temporary hire of experienced attorneys familiar with all facets of the Office is critically needed. Negative action will be prohibitive to the ongoing operations of the District Attorney’s Office until vacant positions can be filled. New employees will require time acclimate and be trained with respect to their assigned function.
