RECOMMENDATION(S):

APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a contract with Thyssenkrupp Elevator Corporation, containing modified indemnification language, in an amount not to exceed $1,300,000 for elevator maintenance, repair and modernization services, for the period June 1, 2018 through May 31, 2021, Countywide. (100% General Funds)  

FISCAL IMPACT:

This cost is to be funded through Facilities Services maintenance budget. (100% General Funds)  









BACKGROUND:

Facilities Services maintains all County facility elevators. Facilities uses the original factory manufacturer for repair, service and parts for these units. Forty eight of the elevators now in service at County facilities are under the Thyssenkrupp Elevator Corporation group. Over the past three years Thyssenkrupp has provided maintenance service and repair on these elevators at a total cost of $857,000. Prices are expected to raise 5% for maintenance this year, and several costly repair issues have presented themselves in some of the aging elevators. Facilities is requesting a contract for $1,300,000 for estimated maintenance, repair, and modernization of these units. Government Code Section 25358 authorizes the County to contract for maintenance and upkeep of County facilities. Facilities Services is requesting a contract be put in place for three years for elevator maintenance and repair service.  
  
Under the contract, the County will be obligated to defend and indemnify the Contractor from claims and losses for death or injury to persons arising directly or indirectly from the operation or condition of the elevator equipment that are caused by the negligence or willful misconduct of County. County will not be required to indemnify Contractor for the proportion of liability a court determines is attributable to the negligence or willful misconduct of the Contractor

CONSEQUENCE OF NEGATIVE ACTION:

If this contract is not approved, elevator maintenance, repair, and modernization services will be discontinued.
