RECOMMENDATION(S):

ACKNOWLEDGE and ACCEPT the results of the representation election of the Public Defender Investigators Unit to remain represented by the CCC Public Defenders Association Unit, as recommended by the Employee Relations Officer.  

FISCAL IMPACT:

No fiscal impact.

In October 2016, members of the Defenders' Association submitted a petition to the Labor Relations Department requesting a unit modification to create a new bargaining unit containing the Public Defenders Investigators classifications. As part of the modification petition, members in the classifications of the Public Defenders Investigators also sought to be represented by IFPTE, Local 21. The modification process proceeded pursuant to Section 34-12.016 of the County's Employer-Employee Relations Resolution (EERR). The parties met and agreed to the establishment of the Public Defenders Investigators Unit on January 4, 2017. The Board of Supervisors approved this action on January 17, 2017. Thereafter, the Labor Relations Department requested California State Mediation and Conciliation Service (SMCS) to serve as a neutral party to conduct the representation election in accordance with Sections 34-12.012 and 34-12.016 of the EERR. On April 21, 2017, a vote count was conducted by SMCS to determine which organization would represent the Public Defenders Investigators Unit.   
  

  
The following are the results of the election:  
  
CCC Public Defenders Association: 6 votes  
IFPTE, Local 21: 4 votes  
No Organization: 0 votes  
Total Ballots Cast: 10  
Total Eligible Employees in the CCC Public Defenders Association - Investigators Unit: 11  
  
SMCS certified the election results. More than fifty percent (50%) of eligible employees in the Investigators Unit cast ballots in the election and a majority of the votes cast selected to remain represented by the CCC Public Defenders Association.   

CONSEQUENCE OF NEGATIVE ACTION:

The election results will not be formally acknowledged.
