RECOMMENDATION(S):

ADOPT Resolution No. 2017/133, which supersedes Resolution No. 2016/554, regarding compensation and benefits for the County Administrator, County Elected and Appointed Department Heads, Management, Exempt, and Unrepresented employees to reflect changes.

FISCAL IMPACT:

None. These changes are administrative.

BACKGROUND:

Historically, the wages and benefits granted by the County to its department heads, managers, and unrepresented employees have paralleled the wages and benefits negotiated by the County with its various labor organizations. The modifications described below modify and clarify the benefits for specified groups of unrepresented employees, and make technical non-substantive corrections and clarifications.

The attached Management Benefits Resolution has been modified in the following ways:

  1. A new heading, Section 4, Transportation Expense has been added. Former Section 4 Mileage Reimbursement is now subsection 4.10. New subsection 4.11 Commuter Benefit Program has been added to provide employees the opportunity to set aside pre-tax dollars for qualified transportation expenses.
  2. Section 10, Workers' Compensation and Continuing Pay has been revised to omit obsolete language addressing the payment level that applied in 2007.
  3. Section 1.15 No County Overtime Pay, Holiday Pay, or Comp Time, has been revised to clarify that the prohibition against County overtime pay does not preclude payment of FLSA overtime to eligible employees as required by law.
  4. Section 11.10 Overtime Exempt Exclusion and 11.11 County Overtime have been revised to clarify the circumstances under which employees who are exempt from FLSA overtime may be placed on the Overtime Exempt Exclusion list to be eligible for County overtime pay.
  5. Section 14.E Annual Management Administrative Leave, has been added to clarify that employees who are eligible for FLSA overtime are not eligible for Management Administrative Leave.
  6. For ease of reference in Part III, Section 26, Elected Department Head Benefits was retitled Elected Department Head Benefits and Board of Supervisors Members Benefits. This section now has two subsections, 26.10 Elected Department Head Benefits and 26.11 Board of Supervisors Members Benefits. There were no changes or additions to benefits for these officials.
  7. References to class codes were added or corrected in sections 30.11, 38, and 50. No substantive changes were made to these sections.
  8. The classifications of Associate Appraiser, Assistant Appraiser, and Junior Appraiser are now unrepresented and covered by the Management Resolution. The benefits specific to this group are now provided in Part IV, Special Benefits for Employees by Department or Class, new Section 42 Property Appraisers. The benefits stated in subsections 42.10-42.20 include longevity pay, a Standards Division differential, an educational incentive differential, opportunity for a summer schedule, additional group term life insurance, professional development reimbursement, the deferred compensation Special Benefit and access to the deferred compensation loan program, additional personal holiday credit, and flexible compensatory time. These classifications do not receive the benefits provided in Part II "Benefits for Management and Exempt Employees," except as specifically provided in Section 42. Section 42.13 establishes the probationary period for the classification of Junior Appraiser.
  9. Subsection numbering and lettering was changed in Sections 2.16, 2.19, 13, 16, 21, 26, 30.11, 30.12, 31.10, 36.10, 44.10, and 53.10 so that a consistent style of identifying subsections is used throughout the Resolution. No substantive changes were made to these sections.

CONSEQUENCE OF NEGATIVE ACTION:

If the action is not approved the resolution will not track current policy.
