RECOMMENDATION(S):

APPROVE and AUTHORIZE County Counsel or her designee to execute, on behalf of Contra Costa County and the County acting as the Successor Agency to the Contra Costa County Redevelopment Agency, amendments to existing agreements for specialized professional legal services with Goldfarb & Lipman to modify the list of attorneys that are authorized to provide services to the County and the Successor Agency.

FISCAL IMPACT:

There is no fiscal impact. The amendment only modifies the list of attorneys that may provide services to the County and the Successor Agency.   









BACKGROUND:

The contracts being amended are for legal services related to the County’s affordable housing programs. Each contract includes an exhibit that identifies by name every attorney with Goldfarb & Lipman. Since the contracts were executed, some of the names have changed and some work has been performed by attorneys not identified on the exhibit. Each contract, as amended, will include an exhibit that identifies by name the firm’s attorneys and other professionals. Each contract will also include a separate exhibit that shows the hourly rate of employees in different job classifications. This change to each contract will allow invoices to be paid when work is performed by a Goldfarb & Lipman attorney or other professional, even when that person is not named on the exhibit to the contract.  

CONSEQUENCE OF NEGATIVE ACTION:

Payment for work performed by the firm may be wrongfully delayed for withheld.
