RECOMMENDATION(S):

1. SUBMIT to East Bay Regional Park District (EBRPD), the Measure WW Park Bond Funds Local Program Project Application for Tice Valley Linear Park in the amount of $600,000;  
  

2. FIND that the proposed project is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301(c) and Section 15311 of the CEQA Guidelines; and

3. DIRECT the Director of Conservation and Development to file a Notice of Exemption with the County Clerk and pay the filing fee.

FISCAL IMPACT:

No impact to the County General Fund. All project costs will be funded by revenue from local grant funds from East Bay Regional Park District under the Measure WW Park Bond Extension.

BACKGROUND:

In November 2008, Alameda and Contra Costa County voters approved the East Bay Regional Park District’s (EBRPD) Measure WW Regional Open Space, Wildlife, Shoreline and Parks Bond Extension. From that measure, a total of $7.93 million is allocated for local park purposes to areas within the unincorporated area of the county. These funds were allocated to specific County Services Areas (CSA) ($2.49 million), Community Service Districts (CSD) and local Recreation and Park Districts ($2.39 million), and to unincorporated areas not in a CSA, CSD or local park district ($3.05 million). On December 15, 2015, the Board of Supervisors authorized the Department of Conservation and Development to enter into a Master Contract with East Bay Regional Park District for the distribution of the third category, the approximately $3.05 million to unincorporated areas not in a CSA, CSD or local park district. Tice Valley Linear Park was identified as a Measure WW funded project in the December 15, 2015 Board Authorization.  
  
The proposed project includes the design and construction of an all-weather pathway along Tice Valley Boulevard to provide a safe pathway between a residential neighborhood and the Tice Valley Community Gym and Tice Valley Park. The project also includes the design and construction of a park feature to create a pocket park at the bus stop located at the intersection of Montecillo Drive and Tice Valley Boulevard.  
  
The pocket park may include, but is not limited to, the following features: bench, a historical monument, a trellis, and planting boxes. The proposed project will create a safe pathway for residents as well as expand recreational opportunities. Real property transactions, including right-of-way acquisitions and temporary construction easements may be necessary in support of the project.  
  
A drainage ditch and culvert in the project area may be modified or relocated to accommodate the proposed pathway. Tree and shrubbery removal and trimming will be minimized but may be necessary throughout the project area. During construction, a staging area will be created nearby and there may be minor temporary traffic impacts such as lane or driveway closure. Emergency vehicles will have access at all times. Advance warning will be provided to property owners of any construction related impacts.   
  
The project is exempt from CEQA under Sections 15301 and 15311 of the CEQA code. Section 15301 provides an exemption for existing facilities and the project will take place along the frontage of Tice Valley Boulevard. Section 14311 provides an exemption for the construction of accessory structures. The project includes the design and construction of park elements such as benches, a historical monument, a trellis, and planting boxes.

CONSEQUENCE OF NEGATIVE ACTION:

Project will not be funded with Measure WW funds and improvements will either not be implemented or be delayed until alternative funded sources can be secured.

CHILDREN'S IMPACT STATEMENT:

The proposed project will support the following community outcomes established in the Children's Report Card:  
  
1) Children and youth are healthy and preparing for a productive adulthood;  
2) Families are safe, stable and nurturing;  
3) Communities are safe and provide a high quality of life for children and families.
