RECOMMENDATION(S):

APPROVE and AUTHORIZE the Conveyance of a Grant Deed from Contra Costa County (County) to the Town of Danville identified as Assessor's Parcel Number (APN) 216-062-026 which is located between Laurel Drive and Sycamore Valley Road, for drainage purposes, pursuant to Government Code Section 25365. (Project No.: 7505-6F8271)   
  

DETERMINE said property is no longer necessary for County purposes but is required by the Town of Danville for drainage purposes.  

  




RECOMMENDATION(S): (CONT'D)
AUTHORIZE the Chair, Board of Supervisors, to execute said Grant Deed on behalf of the County.  
  
DIRECT the Real Estate Division of the Public Works Department to deliver a certified copy of this Board Order with the Grant Deed to the Town of Danville for acceptance and recording in the office of the County Clerk-Recorder.

FISCAL IMPACT:

No fiscal impact.

BACKGROUND:

The County has owned drainage facilities within the city limits of Danville since 1962. The Town of Danville has been maintaining the facilities in this area since its incorporation and has requested that the County transfer ownership of APN 216-062-026 to the Town of Danville to complete its ownership of the drainage channel and related drainage facilities within the property.  
  
The Notice of Intent to convey the Real Property to the Town of Danville was published in the Contra Costa Times at least one week prior to this Board meeting, as required by Government Code Sections 6061 and 25365.  
  
This is a conveyance of title only, the use and operation of the property will remain the same.

CONSEQUENCE OF NEGATIVE ACTION:

The County would continue to have liability on a drainage parcel within the Town of Danville.
