RECOMMENDATION(S):

RECEIVE this report concerning the final settlement of Amy Havea and AUTHORIZE payment from the Workers' Compensation Internal Service Fund in an amount not to exceed $120,000, less permanent disability advances.

FISCAL IMPACT:

Workers' Compensation Internal Service Fund payment of $120,000, less permanent disability advances.

BACKGROUND:

Attorney Mark A. Cartier, defense counsel for the County, has advised the County Administrator that within authorization an agreement has been reached settling the workers' compensation claim of Amy Havea vs. Contra Costa County. The Board's April 4, 2023 closed session vote was: Supervisors Gioia, Andersen, and Burgis - Yes; Supervisors Carlson and Glover - Absent. This action is taken so that the terms of this final settlement and the earlier April 4, 2023 closed session vote of this Board authorizing its negotiated settlement are known publicly.

CONSEQUENCE OF NEGATIVE ACTION:

Case will not be settled.
