RECOMMENDATION(S):

APPROVE and AUTHORIZE the Health Services Director, or designee to execute on behalf of the County Amendment Agreement #29-533-5 (State #17-94578, A01) with the Department of Health Care Services, to update terms and conditions to comply with federal regulations as determined by the Centers for Medicare and Medicaid Services for continuation mental health services to Medi-Cal eligible residents of Contra Costa County, for the period from July 1, 2017 through June 30, 2022.

FISCAL IMPACT:

Approval of this amendment will allow the County to be paid for continuation mental health services in accordance with Chapter 3, Part 2, Division 5 of the Welfare and Institutions Code along with Sections 5600, 5750, 5650 and Government Code Sections 11138, 14705, and 14718 for Medi-Cal eligible clients. No County match is required.








BACKGROUND:

On August 7, 2018, the Board of Supervisors approved Standard Agreement #29-533-4 with the Department of Health Care Services for the provision of Managed Mental Health Care for Medi-Cal eligible residents of Contra Costa County through June 30, 2022, which included agreeing to indemnify and hold the State harmless for claims arising out of the County’s performance under the Agreement. The County has been contracting with the State for these services since 2012.  
  
The goal of the managed care project is to provide covered mental health services, including medication support, day treatment intensive, day rehabilitation, crisis intervention, crisis stabilization, adult residential treatment, crisis residential, psychiatric health facility and targeted case management services. Covered mental health services include psychiatric inpatient treatment and early periodic screening, diagnosis and treatment (EPSDT) supplemental specialty mental health services.   
  
In order to comply with federal regulations as determine by the Centers for Medicare and Medicaid Services, the State is amending the prior contract to update terms and conditions with no change in the amount payable to the County or term through June 30, 2022.   
  
Approval of Standard Agreement #29-533-5 will allow the County to continue to receive funds to support the Managed Mental Health Care Project through June 30, 2022 to ensure continuity of specialty mental health services to Medi-Cal eligible residents in Contra Costa County.

CONSEQUENCE OF NEGATIVE ACTION:

If this amendment is not approved, the County will not be able to continue providing managed mental health care services to Medi-Cal eligible residents of Contra Costa County.
