RECOMMENDATION(S):

APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a lease amendment with Lippow Development Company to modify the lease term to align it with the fiscal year of the funding source, as requested by the District Attorney, under the terms and conditions set forth in the lease amendment. (WLP870)

FISCAL IMPACT:

No fiscal impact.

BACKGROUND:

Pursuant to a Memorandum of Agreement between the Federal Bureau of Investigation (FBI) and the County, the FBI is providing funds to the County to pay for the cost of leasing the site. The lease amendment will modify the lease term to align it with the expected timing of the FBI’s annual budget process. If at any time the FBI elects to discontinue funding, the County may choose to terminate the lease, rather than extending it for an additional year.

Not applicable.



CONSEQUENCE OF NEGATIVE ACTION:

Not authorizing the lease amendment will make it difficult to coordinate the termination of the lease or the exercising of the lease extension option for the lease.
