RECOMMENDATION(S):

APPROVE and AUTHORIZE the Conservation and Development Director, or designee, to execute a contract amendment with with Environmental Science Associates (ESA), to extend the term from April 23, 2015 through April 22, 2016 and increase the payment limit by $144,820 to a new payment limit of $356,632 to provide continued service to complete the environmental impact report (EIR) for the Saranap Village Mixed-Use Project.

FISCAL IMPACT:

100% Development Application Fees, all costs associated with preparing the EIR are borne by the project applicant, Hall Equities Group.

BACKGROUND:

On April 23, 2014, the Department of Conservation and Development (DCD) contracted with ESA to prepare an EIR for the Saranap Village Mixed-Use Project. The Draft EIR was released for public review and comment on November 17, 2014. Over 200 letters and emails were received, many of which criticized the project's size. The project applicant has revised the design in response to these comments. The scope of the revisions necessitates recirculation of portions of the Draft EIR. As the original EIR contract did not contemplate a recirculation, an amendment is necessary to cover the additional costs and to extend the term of the contract.



CONSEQUENCE OF NEGATIVE ACTION:

If the contract with ESA is not amended, then it will expire on April 23, 2015, with the Saranap Village EIR being incomplete. The project cannot move forward without a complete environmental review.
