RECOMMENDATION(S):

APPROVE and AUTHORIZE the Public Works Director, or designee, to waive Bay Point Area of Benefit fees in an amount not to exceed $17,000, for Contra Costa County Fire Protection District’s new Bay Point fire station, based on the Fire District’s substantially similar use from an existing Bay Point Fire station that will no longer be used for emergency response purposes, as recommended by the Public Works Director, Bay Point area. (District V)

FISCAL IMPACT:

Waiver of the Bay Point Area of Benefit (AOB) fee will result in a reduction of approximately $17,000 in revenue to the Bay Point AOB fund. (100% Bay Point Area of Benefit)


BACKGROUND:

AOB traffic impact fees are imposed on all new development throughout the County. Area of Benefit fees are assessed under Ordinance No. 2016-18 based upon the anticipated impact of that development on the road network. The ordinance does not include an exemption for public buildings. Fire stations are fundamental emergency response facilities that serve the community. When accidents occur on the roadway, it is the first responders who return the roadway back to service. Moreover, the existing fire station operations are moving from the existing station to the new station.  
  
Staff recommends that a waiver for the new fire station is allowed because the new station operations will be similar to those of the existing station. The regional transportation funding authority, East Contra Costa Regional Fee and Financing Authority (ECCRFFA), has already waived regional traffic fees for the proposed fire station under its policy that exempts public safety buildings from ECCRFFA fees.

CONSEQUENCE OF NEGATIVE ACTION:

Failure to waive Bay Point AOB fees for the proposed fire station will result in an additional cost burden on the fire district which could either delay construction or reduce budget for materials and resources to equip the new facility.
