RECOMMENDATION(S):

APPROVE and AUTHORIZE the Health Services Director, or designee, to execute on behalf of the County Contract #23-710 with Fulgent Therapeutics, LLC, a limited liability company, including mutual indemnification, in an amount not to exceed $350,000, to provide COVID-19 clinical laboratory services for Contra Costa Health Services (CCHS), for the period March 15, 2021 through June 14, 2021.

FISCAL IMPACT:

Approval of this contract will result in an expenditures of up to $350,000 and will be funded 100% by applicable Federal and State emergency funding.

BACKGROUND:

This contract will establish a relationship between CCHS and the contractor to increase the County's ability to processes lab specimens related to COVID-19 testing collected throughout the County and reduce delays in receiving test results. Fulgent Therapeutics, LLC is an independent laboratory that has the facilities and expertise to provide COVID-19 testing to physicians, hospitals, laboratories and other entities including employers qualified to purchase and provide COVID-19 testing services to individuals.

BACKGROUND: (CONT'D)
Approval of Contract #23-710 will allow this contractor to provide clinical laboratory services for CCHS through June 14, 2021. This contract includes mutual indemnification to hold harmless both parties for any claims arising out of the performance of this contract.

CONSEQUENCE OF NEGATIVE ACTION:

If this contract is not approved, the County will not have access to this contractor’s clinical laboratory services and COVID-19 testing results may be delayed.
