RECOMMENDATION(S):

APPROVE and AUTHORIZE the Agricultural Commissioner, or designee, to execute an agreement with East Bay Regional Park District for the County to provide Vertebrate Control Services in an amount not to exceed $5,000 for the period January 1, 2021 through December 31, 2021.  

FISCAL IMPACT:

Approval of this agreement will result in reimbursement to the County in an amount not to exceed $5,000 for Vertebrate Control services in various East Bay Regional Parks. There is no other County match.  









BACKGROUND:

The Department of Agriculture shall supply products and labor to provide Ground Squirrel control services that have been approved by East Bay Regional Park District's Integrated Pest Management department. Products will be distributed at East Bay Regional Parks within the jurisdiction and operation of the Department. The Department will ensure product is in compliance with all Federal and State laws and regulations. This agreement has a mutual indemnification provision, which provides that each party will defend and indemnify the other for injuries or losses arising out of the performance of the agreement.  

CONSEQUENCE OF NEGATIVE ACTION:

A negative action would cause loss of revenue to the Department and an increase in the number of ground squirrels causing detrimental destruction in East Bay Regional Parks and eventually into adjacent properties.
