3. AWARD the construction contract for the above project to D.L. Falk Construction Inc., in the amount of $3,429,000, and DIRECT that the Fire Chief, or designee, prepare the contract.
4. DIRECT that D.L. Falk Construction Inc., shall submit two good and sufficient security bonds (performance and payment bonds) in the amount of $3,429,000 each.
5. ORDER that, after the contractor has signed the contract and returned it, together with the bonds, evidence of insurance, and other required documents, and the Fire Chief has reviewed and found them to be sufficient, the Fire Chief, or designee, is authorized to sign the contract for this Board.

with the project specifications and upon signature of the contract by the Fire Chief, or designee, any bid bonds posted by the bidders are exonerated and any checks or cash submitted for bid security shall be returned.
7. AUTHORIZE the Fire Chief, or designee, to sign any escrow agreements prepared for this project to permit the direct payment of retentions into escrow or the substitution of securities for moneys withheld by the County to ensure performance under the contract, pursuant to Public Contract Code Section 22300.
8. AUTHORIZE the Fire Chief, or designee, to order changes or additions to the work pursuant to Public Contract Code Section 20142.
9. DELEGATE, pursuant to Public Contract Code Section 4114, to the Fire Chief, or designee, the Board's functions under Public Contract Code Sections 4107 and 4110.
FISCAL IMPACT:
This project is budgeted in the CCCFPD Capital Outlay Fund (203100).
BACKGROUND:
The purpose of this project is to build a new Fire Station (FS) 16. In late 2011 the Fire District initiated the process for the design of a replacement facility for Fire Station 16 in Lafayette at the present location on Los Arabis Drive. At that time, the station was comprised of a small residential style fire station built in the 1950s that was abandoned shortly after the Loma Prieta Earthquake.
The construction cost estimate is $3,500,000, and the general prevailing wage rates will be the minimum rates paid on this project. Bids were received and opened by the Public Works Department on February 22, 2018, and the bid results are as follows:
BIDDER: D.L. Falk Construction Inc., Hayward CA.
BASE BID: $3,429,000.
Public Works Department staff has determined that D.L. Falk Construction Inc.'s bid is responsive and that the bidder has documented an adequate good faith effort to comply with the requirements of the County's Outreach Program, as provided in the project specifications. Staff recommends that the bid be awarded to D.L. Falk Construction Inc. in the amount of $3,429,000.
Pursuant to the County's Project Labor Agreement (PLA) policy, a PLA is required on this project. D.L. Falk Construction has signed a PLA. The general prevailing rates of wages, which shall be the minimum rates paid on this project, are on file with the Clerk of the Board and copies are available to any parties upon request.
CONSEQUENCE OF NEGATIVE ACTION:
If the project is not approved, a new fire station will not be constructed impacting future emergency response in the area. Alternatively, if the District is directed to proceed under a different course of action, delays would be added to the construction timeline.
