RECOMMENDATION(S):

APPROVE and AUTHORIZE the Public Works Director, or designee, to execute the Agreement Relating to Real Property (Agreement) with Central Contra Costa Sanitary District (District), for use of a portion of their easement, at 255 Glacier Drive in Martinez, for the Renewable Energy Program. The Agreement will become effective upon execution. (Project No. 4402-8B0269)  
  

APPROVE and AUTHORIZE the Auditor-Controller to issue a payment in the amount of $1,404.00 payable to Central Contra Costa Sanitary District, 5019 Imhoff Place Martinez, CA 94553.  




FISCAL IMPACT:

Contra Costa County (County) will pay the District a one-time fee of $929.00 to cover District staff costs to prepare the Agreement and $475.00 for the District’s building inspection fee. The energy cost savings from the Project and receipt of incentives from the California Solar Initiative Program will offset the costs.  

BACKGROUND:

The Contra Costa County Public Works Department is preparing for construction of a Photovoltaic Solar System at 255 Glacier Drive (Project). Construction is scheduled to begin in late April 2015.  
  
A small portion of the solar panels will encroach over approximately 52 square feet of the District’s easement. The District will allow the County to use a portion of their easement, if the County enters into the District’s Agreement.  
  
As a condition of the Agreement, the District has required the County to indemnify them for claims arising out of the County’s use of the easement.

CONSEQUENCE OF NEGATIVE ACTION:

The construction phase will not be able to move forward.
