RECOMMENDATION(S):

REFER to the Ad Hoc Committee on Sustainability a report on Assembly Bill (AB) 1092 (Levine), which established requirements for electric vehicle charging infrastructure in new residential and nonresidential development, and REQUEST evaluation of whether additional local requirements are necessary.

FISCAL IMPACT:

None to the General Fund.

BACKGROUND:

On September 28, 2013 the Governor signed into law AB 1092, which required the California Building Standards Commission, commencing with the next triennial edition of the California Building Standards Code adopted after January 1, 2014, to adopt, approve, codify, and publish mandatory building standards for the installation of future electric vehicle charging infrastructure for parking spaces in multifamily dwellings and nonresidential development.

The County currently does not have ordinance provisions requiring the installation of electric vehicle charging infrastructure in new residential and nonresidential development. This referral will enable the Ad Hoc Committee on Sustainability to evaluate the new State standards and consider recommendations to the Board on what, if any, additional local requirements are necessary.

CONSEQUENCE OF NEGATIVE ACTION:

The Ad Hoc Committee on Sustainability will not evaluate the County's policies regarding the installation of electric vehicle charging equipment in new residential and nonresidential development.
