RECOMMENDATION(S):

ADOPT Resolution No. 2015/73 approving the third extension of the Subdivision Agreement (Right-of-Way Landscaping) for subdivision SD04-08700, for a project developed by Shapell Homes, a Division of Shapell Industries, Inc., a Delaware Corporation, as recommended by the Public Works Director, San Ramon (Dougherty Valley) area. (District II)

FISCAL IMPACT:

No fiscal impact.

BACKGROUND:

The terminal date of the Subdivision Agreement (Right-of-Way Landscaping) needs to be extended. The development is in the warranty period and the bond needs to be kept up to date.

CONSEQUENCE OF NEGATIVE ACTION:

The terminal date of the Subdivision Agreement (Right-of-Way Landscaping) will not be extended and the developer will be in default of the agreement, requiring the County to take legal action against the developer and surety to ensure completion of the warranty items.
