RECOMMENDATION(S):

ADOPT the previously certified City of Antioch Mitigated Negative Declaration for the West Antioch Creek Channel Improvements Project for the purpose of conducting real property transactions associated with the West Antioch Creek Channel Improvements Project in compliance with the California Environmental Quality Act (CEQA) (the custodian of which is the Department of Conservation and Development Director who is located at 33 Muir Road, Martinez); and,  
  

DIRECT the Director of Conservation and Development to file a Notice of Determination with the County Clerk; and,

AUTHORIZE the Chief Engineer, or designee, to arrange for payment of a $50 fee to the County Clerk for filing the Notice of Determination, and a $25 fee to Department of Conservation and Development for processing.  

FISCAL IMPACT:

100% Drainage Area 55 up to $1,800,000.

BACKGROUND:

The City of Antioch published an Initial Study/Mitigated Negative Declaration for the West Antioch Creek Channel Improvements Project in April 2014 which was approved and adopted by the Antioch City Council in September 2014. The project is intended to reduce flooding in the project area by increasing the capacity of West Antioch Creek channel between West 10th Street and West 8th Street and re-establishing the 25-year flood protection capacity of the channel downstream of West 8th Street to the Burlington Northern Sante Fe railroad trestle. Construction of the project will require acquisition of County-owned and privately-owned parcels which will require fee title transactions and permanent and temporary easements to be transferred to the City of Antioch. The City of Antioch has analyzed all impacts of the project and will obtain all necessary regulatory permits and environmental clearances prior to project implementation.

CONSEQUENCE OF NEGATIVE ACTION:

Delay in adopting the CEQA document may result in a delay of property acquisition which could delay project construction.
