RECOMMENDATION(S):

APPROVE and AUTHORIZE the Auditor-Controller, or designee, to distribute the 2013-14 State Highway property rental revenue to the County Road Fund and to eligible cities pursuant to the provisions of Section 104.10 of the Streets and Highways Code, as follows: County Road Fund $62,529.36; City of Lafayette $4,944.00; City of Pittsburg $22,800.00.  
  

APPROVE and AUTHORIZE the Auditor-Controller, or designee, to correct the 2012-13 State Highway property rental revenue distribution by transferring $90,886.32 from the County Road Fund to the City of Pittsburg pursuant to the provisions of Section 104.10 of the Streets and Highways Code.





FISCAL IMPACT:

This action has no impact on the General Fund. The County Road Fund will receive a distribution of $62,529.36 for fiscal year 2013-14 and an adjustment for fiscal year 2012-13 in the amount of $90,886.32 that will be transferred from the County Road Fund to the City of Pittsburg.

BACKGROUND:

Section 104.6 of the Streets and Highways Code authorizes the State Department of Transportation to lease any lands it holds which are not presently needed for State Highway purposes and provides that 24 percent of such rental revenue shall be allocated pursuant to Section 104.10. Section 104.13 provides that all funds distributed to the County shall be deemed to be in full or partial payment of the possessory interest taxes due on such leased properties. The recommended distribution is in accordance with these State laws.  
  
The 2012-13 State Highway property rental revenue included $181,772.63 in rental revenue from a leased property in the incorporated region of Pittsburg. That rental revenue was distributed to the County Road Fund. According to Section 104.10 of the Streets and Highways Code, one-half of that rental revenue ($90,886.32) should be transferred to the City of Pittsburg.

CONSEQUENCE OF NEGATIVE ACTION:

The funds will not be distributed.
