RECOMMENDATION(S):

Approved and authorize the Health Services Director, or his designee (Wendel Brunner, M.D.), to execute on behalf of the County, Standard Agreement Amendment #29-388-51 (#07-65045, A02) with the California Department of Public Health, effective July 1, 2008, to amend Standard Agreement #29-388-49 (as amended by Amendment Agreement #29-388-50), to make technical adjustments to the budget and to decrease the payment limit by $43,212 from $4,701,268 to a new total payable to the County, in an amount to exceed $4,658,056, for the County’s AIDS Programs, with no change in the original term from July 1, 2007 through June 30, 2010.

FISCAL IMPACT:

Approval of this Amendment Agreement will reflect a decrease in funds from the California Department of Public Health for fiscal years 2008/2009 and 2009/2010 of this three year agreement, for a total of $43,212. The reduction was incorporated into the program budgets at the beginning of the fiscal year and the budget projections for the AIDS Program. No County funds are required.

BACKGROUND:

The Master Agreement incorporates a Memorandum of Understanding (MOU) for each service component of the AIDS program which defines the services to be provided and the budget. The MOUs are negotiated by staff of the State Office of AIDS and the County's AIDS Program representatives. The State requires only that the MOUs be signed by the State Office of AIDS Chief and the County's Health Officer, or his designee. This streamlines and expedites the contracting procedure for the AIDS Program, as only the Master Grant Agreement and any formal amendments to the Master Grant Agreement require County Board of Supervisors and State Department of Finance approval.

On November 27, 2007, the Board of Supervisors approved Standard Agreement #29-388-49 (as amended by Amendment Agreement #29-388-50) with the State Department of Health Services, (now known as the California Department of Public Health), for the County’s AIDS Programs including testing services, surveillance, case management, prevention education, outreach, social marketing, and services to women, for the period from July 1, 2007 through June 30, 2010.

Approval of this Standard Agreement Amendment #29-388-51 will make technical adjustments to the agreement, and allow the County to continue provide expanded services in the HIV Prevention, Early Intervention, AIDS Case Management and HIV/AIDS Surveillance Programs, through June 30, 2010.

Four sealed/certified copies of this Board Order should be returned to the Contracts and Grants Unit for submission to the State Department of Health Services.
