RECOMMENDATION(S):

APPROVE and AUTHORIZE the conveyance of two properties in connection with Subdivision 8875 to the City of Brentwood, pursuant to Government Code § 25526.5 and AUTHORIZE the Chair, Board of Supervisors, to execute Grant Deeds on behalf of Contra Costa County Flood Control and Water Conservation District (District) for payment received in full in the amount of $19,774.23.

The Real Property Division is DIRECTED to cause said Grant Deeds to be delivered to the Grantee for acceptance and recording.

FISCAL IMPACT:

The funds received have been deposited into Flood Control Zone 1.

BACKGROUND:

The District acquired certain real property referenced in said grant deeds for flood control purposes. Said properties have been DETERMINED to be surplus and no longer necessary for District purposes and their estimated values do not exceed $25,000. It is beneficial for County to turn over these properties to City of Brentwood as city facilities requiring maintenance are located in the properties.

The Contra Costa County Board of Supervisors adopted the previously certified City of Brentwood Negative Declaration for the Sterling Preserve III subdivision on February 28, 2006.

CONSEQUENCE OF NEGATIVE ACTION:

The District will be responsible for the liability and maintenance of these two parcels that have the City’s facilities on them.
