RECOMMENDATION(S):

INTRODUCE Ordinance 2009-07, which eliminates the staggered terms of the East County Regional Planning Commission and provides that the terms of the members are instead coterminuous with the expiration of the term of the County Supervisor who represents the unincorporated community in which the commission member resides; WAIVE reading and FIX March 31, 2009 for adoption.


DETERMINE that the adoption of Ordinance 2009-07 is exempt from the California Environmental Quality Act (CEQA) in that it can be seen with certainty that there is no possibility of a significant adverse effect on the environment.

DIRECT the Department of Conservation and Development to post a Notice of Exemption with the County Clerk.

FISCAL IMPACT:

None.

BACKGROUND:

On January 27, 2009, the Board directed the Department to draft an ordinance which would establish that the terms of the members of the East County Regional Planning Commission are coterminous with the supervisorial terms of office for District III and District V. The proposed Ordinance 2009-07 provides for this change.

The East County Regional Planning Commission is a five-member body with members representing each of the following five unincorporated communities: Bay Point, Bethel Island, Byron, Discovery Bay and Knightsen. The adoption of the proposed ordinance would extend the terms of the three existing members. The terms of Commissioners Edmond Stevenson who represents Bay Point and Anthony Pigati who represents Knightsen would be extended fifteen months from October 7, 2011 to January 7, 2013. The term of Commissioner Jack Hanna who represents Bethel Island would be extended three months from October 7, 2012 to January 7, 2013.
