DISCUSSION ITEMS
             
        D. 2   PUBLIC COMMENT (2 Minutes/Speaker)
  Thomas Lewis, United Steel Workers, said that USW Local 5 supports the strike in progress at the Tesoro and other refineries, particularly in regard to issues of civil rights, affirmative action and worker safety.  Mr. Lewis said that Shell Oil Company is not compliant in affirmative action employment goals, will not share or discuss its written plan with workers. He said there are discrimination issues that are not being addressed;

Andrew Galvan, spoke in regard to the human remains found on County owned property at 323 Brookside Drive, Richmond. The State of California, Native American Heritage Commission appointed him as the most likely descendant to skeletal human remains discovered, to make recommenations to the property owner for sensitive and dignified treament of the remains.  Mr. Galvan met with county officials from Public Works Real Property division and representatives the developer Urban Tilth in early January. He stated he is in support of the project and requested the Supervisors contact the Public Works division to expedite the creation of a policy to address any additional remains that may be found and to come to an official decision regarding those found;

Christine Lam, In-Home Support Services, thanked the Board for its past support and requested their continuing support for the workers in the current and on-going wage negotiations;

Lisa Kirk, HALO and ASPCA, spoke on her desire and unsuccessful efforts to meet with the current manager or acting director of Animal Services to discuss a policy of trap-neuter-return (aka return to field) for the excessive cat population of Contra Costa County. 

     Mr. Twa, County Administrator, said the County is in progress with interviewing candidates for the position, for which the CAO office will select the department director, and hopes to have the position filled by the end of February of early March.

Andres Soto, Communities for a Better Environment (CBE) and Benicians for a Safe and Healthy Community (BSHC), said that CBE, BSHC, the Sunflower Alliance and the Richmond Progressive Alliance are all involved in climate change issues and the impact of Contra Costa County industries. They all  stand in support of the current strike taking place at the refineries, particularly in the matter of workplace safety. Mr. Soto mentioned the near-miss incident a few days prior in Martinez in which a train collided with a gasoline truck, and informed the Board that the North Richmond Municipal Advisory Commission has voted to support the proposed rescission of Kinder-Morgan's operating permit at the Richmond BNSF yard by the Bay Area Air Quality Management District (BAAQMD).  Mr. Soto requested the support of the Board when these matters come before them for consideration.

and ADOPTED Resolution No. 2013/37 with the minor technical corrections made today, which

1. ACCEPTS the County Zoning Administrator’s recommendations to certify the 2013 Draft and Final EIR, including the entire Recirculated Environmental Impact Report (REIR), consisting of the Recirculated Draft EIR (RDEIR) dated October 2014, and Recirculated Final EIR (RFEIR) dated January 2015.

2. ACCEPTS the County Planning Commission’s recommendations as outlined in Planning Commission Resolution No. 19-2013.

3. CERTIFIES the 2013 Draft and Final EIR, including the entire Recirculated Environmental Impact Report (REIR), consisting of the Recirculated Draft EIR (RDEIR) dated October 2014, and the Recirculated Final Draft (RFEIR) dated January 2015; and CERTIFIES that the Board has reviewed and considered its contents, that it is adequate and complete, that is has been prepared in compliance with the California Environmental Quality Act (CEQA) and the State and County CEQA Guidelines, and that it reflects the County’s independent judgment and analysis. The Department of Conservation and Development, Community Development Division, located at 30 Muir Road, Martinez, CA, is the custodian of the documents and other material that constitute the record of proceedings upon which this decision is based.


4. DENIES the appeals from Communities for a Better Environment and Rodeo Citizens Association, and UPHOLDS the County Planning Commission’s decision to approve the Land Use Permit (County File #LP12-2073) with the added conditions of approval.

5. ADOPTS the findings contained in the County Planning Commission Resolution No. 19-2013, which includes the CEQA findings, Growth Management Standards, and Land Use Permit findings, as the basis for the Board’s action.

6. ADOPTS the attached Mitigation Monitoring and Reporting Program.

7. DIRECTS the Community Development Division to post a Notice of Determination with the County Clerk.

and APPROVED additional Condition of Approval that Phillips 66 will deliver within 60 days of approval of the Land Use Permit a signed and negotiated Community Benefits Agreement requiring Phillips 66 to pay up to $4,255,000 to the County to fund a grant program for physical improvements and/or program developments or enhancements in Rodeo and/or Crockett.

All matters listed under CONSENT ITEMS are considered by the Board to be routine and will be enacted by one motion. There will be no separate discussion of these items unless requested by a member of the Board or a member of the public prior to the time the Board votes on the motion to adopt. 

Persons who wish to speak on matters set for PUBLIC HEARINGS will be heard when the Chair calls for comments from those persons who are in support thereof or in opposition thereto.
