RECOMMENDATION(S):

RECEIVE public report of litigation settlement agreements that became final during the period of January 1, 2014 through January 31, 2014, as recommended by County Counsel.

BACKGROUND:

Three agreements to settle pending litigation, as defined in Government Code section 54956.9, became final during the period of January 1, 2014 through January 31, 2014.

Leonard Alfonso v. Contra Costa County, CCC Sup. Ct. Case No. C13-00308. On January 14, 2014, the Board of Supervisors authorized settlement arising out of a fall on a road in San Pablo. Settlement in the amount of $64,500, inclusive of attorney fees and costs, was authorized in closed session by a 5-0 vote. The settlement became final on January 17, 2014. The settlement amount is paid through the Risk Management Liability Internal Service Fund.   
  
  
Richard Boles v. Contra Costa County, CCC Sup. Ct. Case No. C13-00234. On December 10, 2013, the Board of Supervisors authorized settlement of litigation arising out of a fall at Contra Costa Regional Medical Center. Settlement in the amount of $45,500, inclusive of attorney fees and costs, was authorized in closed session by a 5-0 vote. The settlement amount is paid through the Risk Management Liability Internal Service Fund.   
  
  
In re New Dawn Technologies, Inc. Software Agreement. As part of a settlement agreement resolving a contract dispute between the County and New Dawn Technologies, Inc. over implementation of case management software applications for the District Attorney, Public Defender, and Probation departments, New Dawn Technologies, Inc. agreed to pay $360,000 to the County. The Board authorized settlement on December 3, 2013, in closed session, by a 4-0 vote, Supervisor Gioia absent. The settlement became final on January 22, 2014.  
  
  
This report includes final settlements of litigation matters handled by the Office of the County Counsel. This report does not include litigation settlements that were reported by the Risk Management Division of the County Administrator’s Office as a consent item on the Board’s open session agenda.

CONSEQUENCE OF NEGATIVE ACTION:

The report would not be accepted.
