RECOMMENDATION(S):

Approve and authorize the Health Services Director, or his designee, to execute, on behalf of the County, Standard Agreement Amendment #29 441-37 (State #12-78006-000, A1) with the Department of State Hospitals, effective July 1, 2012, to amend Contract #29-441-36 (State #12-78006-001), to decrease the payment limit by $175,813, from $1,397,741 to a new payment limit of $1,221,928, with no change in the original term of July 1, 2012 through June 30, 2013.

FISCAL IMPACT:

Approval of this amendment agreement will result in a decrease of $175,813 by the State Department of Hospitals for the Conditional Release Program (CONREP). (No County match)


BACKGROUND:

On October 16, 2012, the Board of Supervisors approved Standard Agreement #29 441-36 with the Department of State Hospitals for the period from July 1, 2012 through June 30, 2013, for the CONREP program. This agreement provides funding, for County use, to subcontract with community-based organizations and a number of board and care homes to provide CONREP services to judicially committed patients including agreeing to indemnify and hold harmless the State for claims arising out of County’s performance under this agreement.  
  
Approval of Standard Agreement Amendment #29 441-37 will amend the Agreement to make a technical adjustment to the budget allowing the County to continue to receive funds to support CONREP services through June 30, 2013.  

CONSEQUENCE OF NEGATIVE ACTION:

If this contract is not approved, County will not receive funds to support treatment offered by the CONREP program and may be unable to subcontract with community based organizations, including a number of board and care homes, to judicially committed patients.
