RECOMMENDATION(S):

Approve and authorize the Health Services Director, or designee, to execute, on behalf of the County, Contract Amendment Agreement #26-681-4 with Mark H. Kogan, M.D., a self-employed individual, effective December 1, 2012, to amend Contract #26-681 (as amended by Amendment Agreements #26-681-2 and #26-681-3) to increase the payment limit by $30,038, from $430,000 to a new payment limit of $460,038, with no change in the original term of January 1, 2011 through December 31, 2013.

FISCAL IMPACT:

This Amendment is funded 100% by Enterprise Fund I. No increase in rates.

BACKGROUND:

On January 11, 2011, the Board of Supervisors approved Contract #26-681 (as amended by Amendment Agreements #26-681-2 and #26-681-3) with Mark H. Kogan, M.D., for the period from January 1, 2011 through December 31, 2013, for the provision of gastroenterology services including clinic coverage, gastrointestinal laboratory sessions, consultation, training, on-call coverage and medical and/or surgical procedures. At the time of negotiations the Payment Limit was based on target levels of utilization. However, the utilization was higher than originally anticipated due to another gastroenterologist’s reduction in hours.

Approval of Contract Amendment Agreement #26-681-4 will allow the Contractor to provide additional hours of gastroenterology services through December 31, 2013.

CONSEQUENCE OF NEGATIVE ACTION:

If this amendment is not approved, this physician would not be paid for additional gastroenterology services.

CHILDREN'S IMPACT STATEMENT:

Not applicable.
