RECOMMENDATION(S):

ADOPT Resolution No. 2013/78 establishing a Targeted Employment Area for the Pittsburg/Bay Point Enterprise Zone pursuant to Section 7072(i) of the Government Code in order to encourage businesses within the Enterprise Zone to hire eligible residents from census tracts that are comprised of residents of which at least 51 percent are of low or moderate income.  
  

FISCAL IMPACT:

This action has no fiscal impact. The cost associated with the administration of the Enterprise Zone program is budgeted for through a contract between the Workforce Development Board and the City of Pittsburg and a grant from the Keller Canyon Mitigation Fund.

BACKGROUND:

In 2012 Contra Costa County and the City of Pittsburg completed the requirements for a Final Designation from the California State Department of Housing and Community Development for the Pittsburg/Bay Point Enterprise Zone. Section 7072(i) of the Government Code allows for the designation of a Targeted Employment Area (TEA) to encourage businesses in an Enterprise Zone to hire eligible residents from census tracts that have at least 51 percent of its residents with low or moderate incomes. Only those qualifying census tracts within the boundaries of the jurisdictions (i.e., unincorporated Contra Costa County and/or the City of Pittsburg) governing an enterprise zone may be included in a TEA. Where a census tract is shared between a jurisdiction which is a participant in the enterprise zone and a non-participant jurisdiction, only those areas within the participating jurisdiction may be included in the TEA. Sixteen qualifying census tracts entirely within the boundaries of the jurisdictions and 64 qualifying census tracts partially within the boundaries of the jurisdictions have been identified and mapped. The following census tracts where applicable, within the territorial jurisdictions of the County of Contra Costa and/or the City of Pittsburg, having been determined to have at least 51 percent of its residents with low or moderate incomes and are hereby identified as those census tracts which are in the most need of employment targeting pursuant to Government Code Section 7072(i):

CONSEQUENCE OF NEGATIVE ACTION:

The requirements of the Department Housing and Community Development for the Pittsburg/Bay Point Enterprise Zone will not be fulfilled. In addition, businesses would be ineligible for tax credits from the largest category of qualified employees.
