RECOMMENDATION(S):

ADOPT Resolution No. 2013/75 approving the first extension of the Subdivision Agreement for subdivision SD 91-07553, for a project being developed by Alamo Land Investors, LLC, as recommended by the Public Works Director, Alamo area. (District II)

FISCAL IMPACT:

No fiscal impact.

BACKGROUND:

The Subdivision Agreement needs to be renewed as the improvements are not completed yet (approximately 0% of the work has been completed to date). The developer has requested two more years to complete the improvements. Per Ordinance, Public Works only grants one-year extensions. The Board must approve a longer term. Granting this extension will give the developer additional time to complete the improvements and keep the bonding current.

CONSEQUENCE OF NEGATIVE ACTION:

The Subdivision Agreement will not be renewed for two years if the extension is not granted. The developer will only be allowed one more year if that option is approved, or the developer cannot complete the improvements; the bonds cannot be kept current; and, the County may need to foreclose on the developer’s bonds and complete the improvements.
