RECOMMENDATION(S):

APPROVE and AUTHORIZE the Department of Conservation and Development Director, or designee, to execute a contract amendment with Dr. Richard Denton to increase the payment limit by $30,000 to a new payment limit of $180,000 to provide independent scientific review and analysis of Delta projects and programs with no change in the original term of June 15, 2010 through December 31, 2013.

FISCAL IMPACT:

None to the General Fund. The contract is paid for by funds from the Water Agency.













BACKGROUND:

Dr. Richard A. Denton provides professional services to the Department of Conservation and Development on water quality and water supply issues in the Sacramento-San Joaquin River Delta. Activities under the contract are managed by Water Agency staff, which is housed within the Department. Staff anticipates a heavy workload for the remainder of calendar year 2013 due to the pending publication of the draft Bay Delta Conservation Plan and its environmental impact report/statement and new water quality standards to be released by the State Water Quality Control Board, among other items. These publications, particularly the Bay Delta Conservation Plan, will require the review of extensive and highly technical documents. As of this writing there is approximately $30,000 left in his contract. The 2013 workload will necessitate more work by Dr. Denton than this will cover. The Director of Conservation and Development recommends increasing the payment limit of the contract by $30,000 to a new payment limit of $180,000.

CONSEQUENCE OF NEGATIVE ACTION:

The County will not be able to respond adequately to critical Delta-related plans that could significantly impact our water supply and the water quality along our shoreline.
