RECOMMENDATION(S):

ADOPT Resolution No. 2013/76 to establish the classifications of Deputy County Counsel- Basic- Exempt (2ET1) (unrepresented) at salary level B82 1897 ($7,003.66 - $8,325.15), Deputy County Counsel- Standard- Exempt (2ET2) (unrepresented) at salary level B82 2097 ($8,537.43 - $10,148.32), and Deputy County Counsel- Advanced- Exempt (2ET3) (unrepresented) at salary level ($10,407.08 - $12,370.75) and to establish the terms of the deep class; add one (1) full-time position of Deputy County Counsel- Standard- Exempt (2ET2) (unrepresented) at salary level B82 2097 ($8,537.43 - $10,148.32) and cancel one (1) Deputy County Counsel- Basic (2ETH) (unrepresented) position number 12653 at salary level B82 1897 ($7,003.67 - $8,325.15) in the County Counsel Office.

FISCAL IMPACT:

No impact.

BACKGROUND:

The purpose of this action is to enable the Office of the County Counsel to hire attorneys who have specialized training and/or expertise in specified areas of civil law, so that the Office can efficiently and effectively satisfy the County's legal needs. The new exempt classification will only be used for future hires. It will not apply to current employees.



CONSEQUENCE OF NEGATIVE ACTION:

The current recruitment and hiring processes do not allow the Office of the County Counsel to target and recruit attorneys with specialized training and/or experience in those areas of civil law that are practiced in the Office of the County Counsel when those specialized attorney skills are needed. If this action is not taken, the County Counsel will be unable to recruit the appropriate attorneys it needs when it needs them, to the detriment of County clients.
