RECOMMENDATION(S):

APPROVE and AUTHORIZE the Public Works Director, or designee, to execute an amendment to a Consulting Services Agreement with ENGEO Incorporated, effective December 31, 2012, to increase the amount payable by $75,000 to a new total of $325,000, and extend the completion date of the agreement through December 31, 2013, Countywide. (Project Number 0678-6G5560 and 0678-6G5587)

FISCAL IMPACT:

Work performed under this amendment is funded by Walden Green project funds and the Iron Horse Corridor Trust Fund.












BACKGROUND:

The Public Works Department is involved in various projects in the County which require geotechnical engineering consulting services for road, flood control, and airport projects. After a solicitation process in 2009, this firm and two other firms were selected to provide geotechnical engineering services on an "on-call" basis. On December 15, 2009, a consulting services agreement was approved by the Board of Supervisors. On December 13, 2011, Amendment No. 1 was approved to extend the consulting services agreement for an additional year to continue providing geotechnical engineering consulting services to the County on an on-call basis through December 31, 2012. On March 13, 2012, Amendment No. 2 was approved to increase the payment limit by $100,000 to provide on-call geotechnical engineering services on multiple projects. While most of these projects have been completed, the Walden Green - Phase 2 Project is in its final steps and will be completed by March 31, 2013. The Iron Horse Corridor Risk Assessment project is also underway and is anticipated to be complete within six months.   
  
Approval of this Consulting Services Agreement Amendment No. 3 will allow the Consultant to complete their current tasks on Walden Green - Phase 2 and the Iron Horse Corridor Risk Assessment. The only work to be performed by Consultant under this Amendment No. 3 is the completion of Consultant's work on Walden Green - Phase 2 and the Iron Horse Corridor Risk Assessment.

CONSEQUENCE OF NEGATIVE ACTION:

If this Amendment No. 3 is not approved, the Walden Green - Phase 2 and Iron Horse Corridor Risk Assessment projects will experience delays and added costs as County solicits for new professional services which will duplicate previous work.
