DELIBERATION ITEMS
             
D.1      HEARING to consider appeals filed by Sufism Reoriented, Saranap Homeowners Organization, Sherilyn Fry, Marvin and Carol Rasmussen, Mark Redmond, Patricia Perry, Steven Siegal, Terrence Barnum, Sally Wood and I. Harold Houseley, Curtis and Deborah Trenor, and Robert Nuzum et. al. (Appellants) of a County Planning Commission Decision to Certify the Environmental Impact Report and Approve the 66,074 square foot Sufism Reoriented Sanctuary Project with a Minor Subdivision, Transportation Demand Management Program and Tree Permit. The site is located at 11 White Horse Court, 1354, 1360, 1364, 1366, and 1384 Boulevard Way in the (Saranap) Walnut Creek area. (Applicant & Owner, Sufism Reoriented)(County File #LP08-2034 and #MS09-0008)(Under Special Rules of Procedure adopted February 14, 2012, for this Hearing) (Continued from February 21, 2012).
  Staff presented a PowerPoint report on the questions raised by the Supervisors at the February 21, 2012 meeting. Following discussion, the Board requested the following modifications and additions to the Conditions of Approval for the project: COA No. 7 additions and modifications: Additional language: The Zoning Administrator may determine upon the finding that the TDMP is not in compliance with the approved parking plan. The project sponsor may be required to provide additional parking, monitoring, and limitations on activities. “The project sponsor shall maintain a written parking agreement with an off-site parking provider for use of the parking lots, for overflow parking for evening, weekend, and special events held at the subject site. If the overflow parking site becomes unavailable the project sponsor shall notify the Department of Conservation and Development within 30 days and provide another off-site location within 2 miles of the site for the parking of no fewer than 54 vehicles, within 120 days.” Additional phrase: “Concurrent with the filing of TDM monitoring reports the project applicant shall meet with neighborhood representatives to discuss and attempt to resolve any issues or concerns associated with parking and the TDM program.” ADD sentence: “The Zoning Administrator decision shall be directly appeal-able to the Board of Supervisors” COA 19: Additional language: Within 60 days of the issuance of the final building permit, and quarterly thereafter for three quarters, applicant shall submit a report for the review and approval of the Zoning Administrator which evaluates any potential impact of the light of the dome on the surrounding neighborhood and that can be taken to lessen its impacts. Remove from COA 19 and move to COA 27: “Dome lights shall be turned off at 11:00 p.m.” COA No. 11: “No more than 4 dump trucks and 4 concrete trucks per pump on-site at one time. Project sponsor shall provide off site parking for construction personnel, or provide on-site parking subject to review of the Zoning Administrator. Applicant shall meet with child care provider at the corner of Warren Road and Boulevard Way prior to the beginning of construction to discuss a process for addressing potential impacts to that day care providers business and how those concerns might be addressed" COA No. 21, added phrase “The on-site parking spaces and circulation shall not be used in a manner that would preclude their use as required parking when needed.” Add COA: "Access to the parsonage or residential structure from Warren Road over the existing private access easement shall not be used for access to the Sanctuary and shall be used for access by the residents and their guests and those providing services to the residents. The general members of the church shall not use the private access easement." Add COA: Applicant shall provide or shall designate one contact for the members of the community to answer questions and concerns. CLOSED the hearing; ADOPTED staff recommendations A through G, to include today’s additions and modifications.

GENERAL INFORMATION
The Board meets in all its capacities pursuant to Ordinance Code Section 24-2.402, including as the Housing Authority and the Successor Agency to the Redevelopment Agency. Persons who wish to address the Board should complete the form provided for that purpose and furnish a copy of any written statement to the Clerk.

Any disclosable public records related to an open session item on a regular meeting agenda and distributed by the Clerk of the Board to a majority of the members of the Board of Supervisors less than 72 hours prior to that meeting are available for public inspection at 651 Pine Street, First Floor, Room 106, Martinez, CA 94553, during normal business hours.

The County will provide reasonable accommodations for persons with disabilities planning to attend Board meetings who contact the Clerk of the Board at least 24 hours before the meeting, at (925) 335-1900; TDD (925) 335-1915. An assistive listening device is available from the Clerk, Room 106.
