RECOMMENDATION(S):

APPROVE and AUTHORIZE the Department of Conservation & Development Director, or designee, to execute a contract amendment with Environmental Science Associates to allow an increase of $28,234 from $605,936 to a total amount not to exceed $635,170, for providing continued service to complete the environmental impact report for the Tres Vaqueros Windfarm Repowering Project.

FISCAL IMPACT:

None; 100 percent of consultant costs are covered by permit application fees.

BACKGROUND:

The Department of Conservation & Development contracted with Environmental Science Associates (ESA) in December 2009 to prepare the environmental impact report (EIR) for the Tres Vaqueros Windfarm Repowering Project. The contract has been modified twice to increase the payment limit and extend the term.

The lastest modification was approved in September 2011, while ESA was working to finish the Final EIR. Staff had assumed that ESA would be able to substantially rely on the approaches used in completing the Vasco Winds Repowering Project Final EIR, which was certified in April 2011. However, in practice that was not the case. Twice as many comment letters were received on the Tres Vaqueros Draft EIR than on the Vasco Winds Draft EIR and a fair number of unique issues (as compared to Vasco Winds) were raised. These and other factors combined to increase ESA's level of effort beyond what was expected in the September 2011 budget modification. The Tres Vaqueros Final EIR has been certified and the project has been approved, so ESA's final cost is now known.  
  

CONSEQUENCE OF NEGATIVE ACTION:

If the Board of Supervisors does not take the recommended action, then Environmental Science Associates will not be compensated for work completed on the Final EIR for the Tres Vaqueros Windfarm Repowering Project.  

CHILDREN'S IMPACT STATEMENT:

No impact.
