RECOMMENDATION(S):

APPROVE the Iron Horse Pedestrian Overcrossing project contingency fund increase of $90,000 for a new contingency fund total of $925,830 and a new payment limit of $7,784,130 effective February 28, 2012, Pleasant Hill area. (100% Redevelopment Funds) Project No. 0662-6R4078-05

FISCAL IMPACT:

The Project contingency funds are currently insufficient to cover the increased cost. The increase in contingency funds will be 100% funded by Redevelopment funds previously allocated to the project.

BACKGROUND:

The contractor has filed a Notice of Potential Claim #TEI1 (NOPC #2) on the project related to the bridge deck lighting system. The bridge deck lighting system approved for use in the project has significant ongoing bulb failures associated with the specified product. This contract change order will compensate the contractor for additional work necessary to remove, rework and replace the bridge deck lighting system.

CONSEQUENCE OF NEGATIVE ACTION:

The lack of approval would prevent payment to the contractor for compensation due to them for completing the required work.
