RECOMMENDATION(S):

ADOPT Resolution No. 2012/55 approving the fourth extension of the Subdivision Agreement (Right-of-Way Landscaping) subdivision SD 01-08155 for A project being developed by Windemere BLC Land Company, LLC as recommended by the Public Works Director, San Ramon (Dougherty Valley) area. (District II)

FISCAL IMPACT:

No fiscal impact.

BACKGROUND:

The Subdivision Agreement (Right-of-Way Landscaping) needs to be renewed as the warranty/maintenance period has not been completed. (Approximately 99% of the work has been completed to date.) The developer requested additional time to complete improvements. Granting an extension gives the developer an additional year to complete the improvements and keeps the bonding current.

CHILDREN'S IMPACT STATEMENT:

Not applicable.

CONSEQUENCE OF NEGATIVE ACTION:

The Subdivision Agreement (Right-of-Way Landscaping) will not be renewed if the extension is not granted; the developer cannot complete the improvements; the bonds cannot be kept current; and the county may need to foreclose on the developer’s bonds and complete the improvements.
