RECOMMENDATION(S):

APPROVE and AUTHORIZE the Health Services Director, or designee, to execute, on behalf of the County Standard Agreement (Amendment) #29-388-55 (#10-95254, A01) with the California Department of Public Health, effective July 1, 2011, to amend Standard Agreement #29-388-54, to make technical adjustments to the agreement and to increase the total payment limit by $91,734 from $2,693,403 to a new total payable to the County in an amount to exceed $2,785,137, for the County’s AIDS Programs, with no change in the original term from July 1, 2010 through June 30, 2013.

FISCAL IMPACT:

Approval of this Amendment Agreement will increase funding from the California Department of Public Health by $91,734 due to revised state allocation formulas and the addition of the testing and treatment history program, for fiscal years 2011-2012 and 2012-2013, of this three year agreement. No County funds are required.








BACKGROUND:

The Master Agreement incorporates a Memorandum of Understanding (MOU) for each service component of the AIDS program which defines the services to be provided and the budget. The MOUs are negotiated by staff of the State Office of AIDS and the County's AIDS Program representatives. The State requires only that the MOUs be signed by the State Office of AIDS Chief and the County's Health Officer, or his designee. This streamlines and expedites the contracting procedure for the AIDS Program, as only the Master Grant Agreement and any formal amendments to the Master Grant Agreement require County Board of Supervisors and State Department of Finance approval.   
  
On November 23, 2010, the Board of Supervisors approved Standard Agreement #29-388-54 with the California Department of Public Health, for the County’s AIDS Programs, including testing services, surveillance, case management, prevention education, outreach, social marketing, and services to women, for the period from July 1, 2010 through June 30, 2013. Approval of this Standard Agreement Amendment #29-388-55 will make technical adjustments to the agreement, increase funding and allow the County to continue providing services in the HIV Prevention, Early Intervention, AIDS Case Management and HIV/AIDS Surveillance Programs, through June 30, 2013.   

CONSEQUENCE OF NEGATIVE ACTION:

If this contract is not approved, County will not receive the necessary funding to support the reduction in transmission of HIV, provide case management services that will reduce hospitalization and support to HIV positive individuals to live at home or allow for compliance with State and Federal requirements for reporting of communicable disease.
