RECOMMENDATION(S):

ADOPT Resolution No. 2012/39 approving Covenant Running with the Land, Stormwater Management Facilities Operation and Maintenance Agreement, and Right of Entry for land use permit LP 10-02078 APN 159-040-092, Concord area. (District IV)

FISCAL IMPACT:

No fiscal impact.

BACKGROUND:

A Stormwater Management Facilities Operation and Maintenance Agreement is required by the conditions of approval for [LP 10-02078]. This agreement will ensure the operation and maintenance of the stormwater facilities in accordance with the approved Stormwater Control Plan and approved Operation and Maintenance Plan for this development.

CONSEQUENCE OF NEGATIVE ACTION:

The agreement will not be recorded and Contra Costa County may not be in full compliance with the joint regional National Pollutant Discharge Elimination System (NPDES) permit.

CHILDREN'S IMPACT STATEMENT:
