3. DETERMINE that the project is a Class 1(a) Section 15301 Categorical Exemption under the California Environmental Quality Act (CEQA). (CP#10-58;WLP683)
4. DIRECT the Department of Conservation and Development Director, or designee, to file a Notice of Exemption with the County Clerk, and DIRECT the Deputy Director of General Services, or designee, to arrange for the payment of the handling fees to the Department of Conservation and Development and County Clerk for filing of the Notice of Exemption.
FISCAL IMPACT:
The Second Amendment to Lease will obligate the County to pay a total rent of $49,260 over the initial year of the Amendment. The Second Amendment to Lease is an extension of an existing Lease and represents a decrease in rent of approximately $15,660 per year for the first year, or approximately 24%.
The Second Amendment to Lease includes four additional one-year options. The extension option rents were negotiated to remain flat for two-year periods with 3% increases every two years. Lease costs were anticipated and budgeted in the Employment and Human Services Department’s approved FY 2010/11 budget.
BACKGROUND:
On August 1, 2000, the Board of Supervisors approved a Lease between the County and Earl D. Dunivan and Joanne Dunivan for occupancy of the premises by the Employment and Human Services Department’s (EHSD) Children’s Interview Center (CIC). The County spent approximately $350,000 on the tenant improvements required to modify this space into offices, a specialized children’s reception area, interview rooms, exam rooms, an additional entrance/exit for law enforcement/court officers separated from the front entrance, and associated audio/video equipment required for the CIC. Additionally, the landlord spent approximately $140,000 on building improvements outside of the suites.
This Second Amendment to Lease provides for the County’s continued occupancy of the premises by EHSD. As part of the Real Estate Asset Management Plan evaluation, County-owned spaces were considered, but were determined to be inadequate and cost prohibitive due to the cost of special facility improvements that would be needed to accommodate CIC needs.
CONSEQUENCE OF NEGATIVE ACTION:
If the Second Amendment to Lease is not approved, the County would have to relocate to another location at considerable expense to make the new location suitable for EHSD-CIC needs.
CHILDREN'S IMPACT STATEMENT:
If the Second Amendment to Lease is not approved, the services provided for and on behalf of children at the EHSD-CIC would terminate.
