RECOMMENDATION(S):

AUTHORIZE the Conservation and Development Director, or Designee, to execute a Memorandum of Understanding (MOU) with the California Energy Commission (CEC) to provide design review, plan check and construction inspection services for the Oakley Generating Station.

FISCAL IMPACT:

Following execution of this MOU with the CEC, the Department of Conservation and Development will negotiate a contract with the power plant operator, Radback Energy, for payment to the County for the services to be provided. All County costs will be fully reimbursed from this contract, resulting in no net fiscal impact to the County.

BACKGROUND:

The site of the proposed Oakley Generating Station, currently under consideration by the CEC, is in northeastern Contra Costa County, within the City of Oakley. The address of the 21.95 acre site is 6000 Bridgehead Road. The proposed project is a natural gas-fired, combined cycle facility with a nominal generating capacity of 624-megawatts. CEC staff anticipates final approval of the project by the CEC during the spring of 2011.

The CEC has requested that the Department of Conservation and Development, Building Inspection Division, serve as Chief Building Official for the Oakley Generating Station project. The CEC has the authority to delegate this role to the County through its jurisdiction over power plant construction projects. The County Building Inspection Division has extensive prior experience providing building inspection services for power plant projects, and has served in the capacity of Chief Building Official for previous power plant projects on behalf of the CEC.  

CONSEQUENCE OF NEGATIVE ACTION:

If the proposed MOU with the CEC is not approved, the County will not be able to provide services for the Oakley Generating Station project as proposed by the California Energy Commission.
