RECOMMENDATION(S):

ADOPT Resolution No. 2011/37 authorizing and directing the Auditor-Controller to establish the "Community Corrections Performance Incentives Fund", pursuant to Senate Bill 678 (Chapter 608, Statutes of 2009).

FISCAL IMPACT:

No fiscal impact.

BACKGROUND:

On October 11, 2009, the Governor signed Senate Bill 678, known as the "California Community Corrections Act of 2009", which, among other things, authorizes the establishment of the Community Corrections Performance Incentives Fund (CCPIF) in each county. The State Department of Finance (DOF) will transfer a portion of cost savings realized by the California Department of Corrections and Rehabilitation (CDCR) from reduced referrals of certain probationers to State Prison to local CCPIFs annually. The cost savings calculation will be performed by the State based on statistics provided by local probation departments and CDCR. Revenue deposited in the CCPIF will be restricted to the Probation Department for use in evidence-based probation supervision activities with the ultimate goal of reducing recidivism among adult probationers between the ages of 18 and 25.

CONSEQUENCE OF NEGATIVE ACTION:

The County will not be in compliance with state statute.
