RECOMMENDATION(S):

1. APPROVE a Revenue Lease with Anka Behavioral Health, Inc., for the County-owned premises at 2047 Arnold Industrial Way, Suite A, Concord. The term of the lease is five years beginning February 9, 2011, and ending February 8, 2016, for approximately 2,400 square feet of homeless shelter space, under the terms and conditions set forth in the Revenue Lease.   
  

2. AUTHORIZE the Deputy Director of General Services, or designee, to EXECUTE the Revenue Lease.

3. DETERMINE the project is a Class 1(a) Section 15301 Categorical Exemption under the California Environmental Quality Act (CEQA).  
  
4. DIRECT the Department of Conservation and Development Director, or designee, to file a Notice of Exemption with the County Clerk, and DIRECT the Deputy Director of General Services, or designee, to arrange for the payment of the handling fees to the Department of Conservation and Development and County Clerk for filing of the Notice of Exemption.  

FISCAL IMPACT:

The tenant will perform approximately $68,750 in tenant improvements to the space prior to moving in. The County has agreed to abate rent for a 24-month period in order to reimburse the tenant for the cost of the tenant improvements. The County will receive approximately $104,400 in revenue for the remaining term of the Lease after the rental abatement period. Those funds will be deposited in the Health Services Department - Homeless Program to offset the facility's expenses.

BACKGROUND:

The County owns the property located at 2047 Arnold Industrial Way in Concord. The Health Services Department operates an Adult Emergency Shelter Program and a Respite Program in portions of the building for the homeless in the community. The County will lease Suite A in that building to Anka Behavioral Health, Inc. for it to provide a Drop-in Center for the public. The Drop-in Center will provide behavioral counseling and other supportive services, which may include food service, showers, and laundry services to the homeless.

CONSEQUENCE OF NEGATIVE ACTION:

If the Revenue Lease is not approved, the County will not receive the revenue, and other arrangements will have to be made to provide Respite Center services to the community.
